Terms of Service

Welcome to RSVPoll. These Terms of Service ("Terms") are an agreement between you and Development Leverage Consulting LLC, a California limited liability company ("DevLev", "we", "us"), which operates the RSVPoll service at rsvpoll.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
RSVPoll lets you create scheduling events and polls, share them by link, and collect responses from participants. Participants can respond to a shared event or poll without creating an account.
2. Who may use the Service
You must be at least 13 years old to create an account. If you live in the European Economic Area or the United Kingdom, you must be at least 16, or old enough to consent to the processing of your personal data under the law of your country, whichever is lower.
You may only use the Service in compliance with these Terms and applicable law.
3. Your account
You are responsible for your account and everything that happens under it. Keep your password confidential, and let us know at support@rsvpoll.com if you believe your account has been compromised. You must provide a valid email address; we use it to verify your account and to send you messages about the Service (such as password resets and email confirmations).
You can update your name, email address, and password — and delete your account entirely — from your account settings at any time.
4. Fees
The Service is currently free. We may introduce paid features in the future (for example, charging to create events or polls). If we do, we will give you advance notice, and we will never charge you retroactively for past use or begin charging you without your explicit agreement to a paid plan. Responding to events and polls that are shared with you will remain free.
5. Your content
You keep ownership of the content you submit to the Service — event and poll titles, descriptions, options, and responses ("Your Content"). You grant us a limited license to store, display, and transmit Your Content solely as needed to operate the Service (for example, showing an event page to the people you share the link with). This license ends when Your Content is deleted from the Service.
You are responsible for Your Content. Don't submit anything you don't have the right to share, and don't submit other people's personal information without their permission.
Share links are open to anyone who has them. Anyone with an event or poll link can view that page — including its title, description, and all participants' names and responses — and can submit a response while voting is open. Share links accordingly, and don't put anything in an event or poll that you wouldn't want everyone with the link to see.
6. Acceptable use
You agree not to:
- Use the Service for anything unlawful, deceptive, or harassing;
- Submit responses under false identities, use automation to submit responses, or otherwise manipulate the results of an event or poll;
- Attempt to access other users' accounts or data, or probe, scan, or test the vulnerability of the Service without our written permission;
- Interfere with the operation of the Service, including by imposing an unreasonable load on our infrastructure;
- Use the Service to send spam or to distribute malware;
- Scrape or bulk-collect data from the Service.
We may remove content or suspend or terminate accounts that violate these Terms.
7. Termination
You can stop using the Service and delete your account at any time from your account settings. Deleting your account permanently deletes your events, polls, and their responses.
We may suspend or terminate your access to the Service if you violate these Terms, if we are required to by law, or if we discontinue the Service. Where reasonable, we will give you notice and a chance to export your data first.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that your data will never be lost — please keep your own records of anything important.
9. Limitation of liability
To the maximum extent permitted by law, DevLev will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim arose, or (b) fifty US dollars ($50).
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
10. Changes to the Service and these Terms
We may change or discontinue features of the Service. We may also update these Terms from time to time. If we make a material change, we will notify you — by email or by a notice on the Service — before the change takes effect. Continuing to use the Service after the change takes effect means you accept the updated Terms. The current version will always be available at rsvpoll.com.
11. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in California, and you and we each consent to their jurisdiction.
12. General
These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
